1. Introduction

Betwatch, Inc. ("Betwatch," "we," "us," or "our"), operating the Betwatch.io website and services (collectively, the "Site"), is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our Site or use our services. Please read this Privacy Policy carefully. 1a. Which policy applies to you, and why there are two

Betwatch, Inc. publishes more than one product, and they do not collect the same things. This policy covers the Betwatch.io website and the sports-betting analytics services offered through it.

BlackJack Lab, our blackjack training application, has its own privacy policy at https://betwatch.io/BJL/privacy, and that policy governs the app. The difference is real rather than cosmetic: the website uses Google Analytics and cookies, and may receive location, mobile device identifiers and social-network data as described below. The BlackJack Lab app does none of those things. It contains no third-party analytics, advertising or crash-reporting software of any kind, sets no cookies, reads nothing from your hardware, and never collects your location. If you are reading this because of the app, read the BlackJack Lab policy instead; where the two differ about the app, the BlackJack Lab policy governs.

The two products do share some infrastructure, and it is more honest to say so than to let the separation imply more than it does. A Betwatch account is a single account across both: the same identity service, the same account database, and the same account record. So the account sections of both policies describe the same data, and deleting your account deletes it for both products at once. What is not shared is the usage data. Website analytics and app usage measurement are collected by different systems, for different purposes, and are not combined.

2. Information We Collect

We may collect information about you in a variety of ways. The information we may collect includes:

Personal Data: Personally identifiable information, such as your name, email address, telephone number, and date of birth, that you voluntarily provide to us when you register with the Site, subscribe to our services, or otherwise communicate with us.

Derivative Data: Information our servers automatically collect when you access the Site, such as your IP address, browser type, operating system, access times, and the pages you have viewed directly before and after accessing the Site.

Financial Data: Some Betwatch products are sold as paid subscriptions, including BlackJack Lab. We do not collect or store your card number, and it never passes through our servers. Payments are collected and processed by third-party payment processors: Stripe, where we are the seller, and Apple, where a purchase is made as an in-app purchase and Apple is the seller. What we receive and store is the information needed to know what you are entitled to and to support the purchase: a customer and subscription identifier from the processor, the plan you bought, the amount and currency, invoice identifiers, the brand and last four digits of the card as shown on your receipt, the renewal date, and the country used to determine tax.

Data From Social Networks: User information from social networking sites, such as your name, your social network username, location, gender, birth date, email address, profile picture, and public data for contacts, if you connect your account to such social networks.

Mobile Device Data: Device information, such as your mobile device ID, model, and manufacturer, and information about the location of your device, if you access the Site from a mobile device.

Third-Party Data: Information from third parties, such as personal information or network friends, if you connect your account to the third party and grant the Site permission to access this information.

3. Third-Party Service Providers

We use the following third-party service providers to help deliver, maintain, and improve our services:

Google Analytics: We use Google Analytics to track and analyze usage of our Site. This includes tracking referral sources (where you came from before visiting our Site), session duration, pages visited, navigation patterns, and user flows. Google Analytics uses cookies and similar technologies to collect this information, which helps us enhance the user experience and improve site functionality.

Firebase and Firestore: We use Firebase for user authentication, and Firestore as one of our databases. Your account information, including email and password (which is securely hashed), as well as certain profile information and usage data, may be stored in Firebase/Firestore. This allows us to provide personalized features and maintain your account preferences.

Supabase: We use Supabase as an additional database and backend service. Certain account data, application data, and usage information may be stored and processed through Supabase. Supabase provides secure data storage, authentication support, and real-time capabilities that help us deliver and improve our services.

Cloudflare: We use Cloudflare as a content delivery network (CDN) and for security purposes. Cloudflare may collect your IP address and other technical information as you access our Site to ensure optimal performance and protection against security threats.

Stripe: We use Stripe to process payments where Betwatch is the seller. Stripe collects your card details and billing information directly; they do not pass through our servers and we never store them. Stripe acts as an independent controller of that payment data under its own privacy policy, in addition to processing on our behalf.

Apple: Where a subscription is purchased as an in-app purchase, Apple is the seller. Apple takes the payment, holds the payment method, manages the renewal, charges the applicable tax, and handles refunds. We never receive your card details and do not learn your Apple Account email or name. Apple provides us with a transaction identifier, the product purchased, the environment, and the expiry date.

Prelude: We use Prelude to deliver the one-time verification codes used for phone sign-in. It receives your mobile phone number for the sole purpose of delivering that code.

The data collected through these services is used solely to improve our services, enhance user experience, resolve technical issues, and develop new features based on user behavior and preferences.

Each of these services maintains its own privacy policy that governs how it handles your data. We encourage you to review their respective privacy policies for more information.

4. How We Use Your Information

We may use the information we collect about you for various purposes, including to:

- Create and manage your account.

- Process transactions, manage subscriptions and renewals, and send you the related purchase confirmations, renewal reminders, payment-failure notices, price-change notices and cancellation confirmations. These messages are part of the transaction and are sent whether or not you have opted into marketing.

- Provide, maintain, and improve our services.

- Understand how users navigate our Site and which features they use most frequently.

- Identify user patterns and preferences to enhance the overall user experience.

- Measure the effectiveness of our Site design and functionality.

- Detect and resolve potential technical issues more efficiently.

- Detect, investigate, and prevent fraudulent transactions and other illegal activities and protect the rights and property of Betwatch, Inc. and others.

- Personalize and improve the services and provide content or features that match user profiles or interests.

- Link or combine with information we get from others to help understand your needs and provide you with better service.

- Develop new features and functionality based on user behavior and feedback.

- Carry out any other purpose for which the information was collected.

5. Data Retention

We retain different types of information for varying periods:

Account Information: We retain your account information for as long as your account is active or as needed to provide you services. If you choose to delete your account, we will delete your account information within 30 days, except as noted below.

Transaction Data: We retain transaction data for 7 years to comply with tax and accounting requirements. This obligation survives deletion of your account: if you have paid us, we must keep a record of the sale even after the rest of your account information is deleted.

Communication Data: We retain communication data (e.g., emails, support requests) for 2 years from the date of the communication.

Analytics Data: Anonymized analytics data may be retained indefinitely for business and service improvement purposes.

Even after you delete your account, we may retain certain information as required by law or for legitimate business purposes, including to prevent fraud, assist with investigations, resolve disputes, analyze or troubleshoot programs, enforce our Terms of Service, or take other actions permitted by law.

6. Disclosure of Your Information

We may share your information as follows:

With Third-Party Service Providers: We may share your information with third-party service providers that perform services for us or on our behalf, including payment processing, data analysis, email delivery, hosting services, customer service, and marketing assistance.

With Affiliates: We may share your information with our affiliates, in which case we will require those affiliates to honor this Privacy Policy.

For Legal Reasons: We may disclose your information if required to do so by law or in the good faith belief that such action is necessary to (a) comply with a legal obligation, (b) protect and defend the rights or property of Betwatch, Inc., (c) act in urgent circumstances to protect the personal safety of users of the Site or the public, or (d) protect against legal liability.

With Your Consent: We may share your information with third parties when we have your consent to do so.

Business Transfers: If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, your information may be sold or transferred as part of such a transaction as permitted by law and/or contract.

While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, we cannot guarantee complete security if you provide personal information.

We do not store your sportsbook passwords in plaintext. We use Firebase and Supabase for secure authentication and storage of any passwords related to your Betwatch account.

11. Data Breach Procedures

In the event of a data breach that compromises your personal information, we will notify you and the appropriate authorities within 72 hours of becoming aware of the breach, where feasible. This notification will include:

- The nature of the breach

- The categories and approximate number of personal data records concerned

- The likely consequences of the breach

15. Controls for Do-Not-Track Features

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.

16. Options Regarding Your Information

Account Information: You may at any time review or change the information in your account or terminate your account by logging into your account settings and updating your account, or by contacting us using the contact information below. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Service, and/or comply with legal requirements.
